These Terms of Service ("Terms") govern your use of the Forte Platforms compute hosting service ("Forte," "the Service," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Service Description

Forte is a compute platform that enables you to build, deploy, and manage containerized applications. The Service includes project management, automated builds from source code repositories, container hosting, deployment orchestration, and related tools.

2. Early Access

Forte is currently in early access. The Service is provided on an "as is" and "as available" basis. During early access:

  • Features may change, be removed, or be added without prior notice.
  • We do not guarantee any specific uptime or availability targets.
  • The Service may experience interruptions for maintenance or updates.
  • Pricing and plan structures may change as the platform evolves.

3. Account Responsibilities

  • You must provide accurate information when creating your account.
  • You are responsible for maintaining the security of your account credentials, API keys, and session tokens.
  • You are responsible for all activity that occurs under your account.
  • You must notify us promptly if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to use the Service to:

  • Host, distribute, or facilitate illegal content or activities.
  • Send spam, phishing, or unsolicited communications.
  • Distribute malware, viruses, or other harmful software.
  • Perform cryptocurrency mining without prior written approval.
  • Attack, disrupt, or attempt to gain unauthorized access to other systems or networks.
  • Violate the intellectual property rights of others.
  • Exceed reasonable usage limits or abuse platform resources.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Your Content and Intellectual Property

You retain all ownership rights to the source code, applications, and data you deploy on Forte. We do not claim any intellectual property rights over your content. We access your content only as necessary to provide the Service, such as building and deploying your applications.

6. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or other operational reasons. We will make reasonable efforts to provide advance notice of planned downtime.

7. Termination

You may close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, we will make reasonable efforts to allow you to retrieve your data for a limited period.

8. Limitation of Liability

To the maximum extent permitted by law, Forte and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.

10. Changes to These Terms

We may update these Terms from time to time, particularly as Forte exits early access. We will notify you of material changes via email or through the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
